Consumer Information Notice
pursuant to Sections 1811(2) and 1820(1) of Act No. 89/2012 Coll., the Civil Code
(hereinafter referred to as the “Notice”)

(hereinafter referred to as the “Real Estate Intermediary”)
and addressed to all potential clients of the Intermediary
who are acting in the capacity of consumers (as defined in Section 419 of the Civil Code) and who are interested in entering into a Brokerage Agreement (in the field of real estate) with the Intermediary
(hereinafter referred to as the “Interested Party”)
The Real Estate Intermediary hereby, in accordance with applicable legal regulations, informs each individual Interested Party (in connection with the Brokerage Agreement the Interested Party intends to conclude with the Real Estate Intermediary) that:

The Brokerage Agreement falls under the regime of the Real Estate Brokerage Act;

The subject of the service offered by the Real Estate Broker shall be the brokerage of: sale of real estate / lease of real estate (including lease arrangements for the Client as tenant) / sublease of real estate (including lease arrangements for the Client as tenant) / transfer of a share in a corporation excluding a housing cooperative share / transfer of a cooperative share to a third party;

The subject of the brokerage shall be offered at the price stated in the Brokerage Agreement (i.e. the so-called recommended price);

The Brokerage Agreement is concluded for a fixed term (as specified in the Brokerage Agreement) - with the option of automatic extension (by the originally agreed duration), unless one of the contracting parties delivers written notice by registered mail to the other party at least 30 days before the end of the agreed term (including any extension) that it wishes to terminate the Brokerage Agreement;

The service fee (i.e. the Commission) shall be a specific – agreed – percentage of the actual price (as stated in the Real Estate Agreement); VAT shall always be added to the calculated Commission (see below). In the case of lease/sublease brokerage, the Commission shall be a fixed (lump-sum) amount stated in the Brokerage Agreement.

The Commission shall always be subject to value-added tax (VAT) in accordance with applicable legislation, with the current VAT rate being 21% of the tax base (i.e. the agreed Commission). The Client shall thus be obliged to pay the Real Estate Broker both the agreed Commission and the applicable VAT.

The Commission shall be due on the date of signing the Real Estate Agreement (i.e. the Target Agreement concluded between the Client and the person arranged by the Real Estate Broker);

All costs incurred by the Real Estate Broker in connection with activities under the Brokerage Agreement are included in the agreed Commission;

The Brokerage Agreement is concluded in accordance with the Real Estate Brokerage Act; the Client's rights related to any defective performance of services, as well as the terms of such rights, are governed by Sections 1914 et seq. of the Civil Code (in particular, Sections 1915–1916 and 1921–1925).
Special notice on the right to withdraw from the Brokerage Agreement, if concluded outside the broker's usual place of business (see also Section 1828/2 of the Civil Code):

You have the right to withdraw from the Brokerage Agreement (without stating a reason) within 14 days of its conclusion.

To exercise the right of withdrawal from the Brokerage Agreement, you must inform (insert your full name, company name, registered address, and optionally your phone, fax number and email address) of your decision to withdraw via a clear declaration (e.g. a letter sent by post, fax, or email). You may use the sample withdrawal form below, but this is not mandatory.

To comply with the withdrawal deadline, it is sufficient to send the notice of withdrawal before the 14-day period expires.
We explicitly inform you (pursuant to Section 1837 of the Civil Code) that you will not have the right to withdraw from the Brokerage Agreement (under the above conditions) if you requested the services to begin during the withdrawal period and the Real Estate Broker arranged (at the latest on the day before sending the withdrawal notice) a person interested in leasing the subject property under the terms set in the Brokerage Agreement. In such case, the Real Estate Broker will disregard your withdrawal notice, regardless of whether you were informed about the arranged person. This does not affect your right to judicial review.

The Client also has the right to submit a complaint (if they believe that their consumer rights were violated by the Real Estate Broker) to the Czech Trade Inspection Authority or the relevant municipal trade licensing office. The Real Estate Broker refers the Client to the wording of Act No. 634/1992 Coll., on Consumer Protection, as amended.
The Client has the option of out-of-court settlement of any consumer disputes, if acting as a consumer. Full information on this issue is available on the website of the Czech Trade Inspection Authority at www.coi.cz. All submissions concerning consumer disputes between the Real Estate Broker and the Client must be addressed to the Czech Trade Inspection Authority.
